DUMPSTER RENTAL AGREEMENT

This Dumpster Rental Agreement ("Agreement") is made between EK Disposal Services LLC ("Company") and the individual or entity renting the equipment ("Customer"). By scheduling a delivery or making payment to the Company, the Customer agrees to be bound by the following terms and conditions.

1. LIABILITY DISCLAIMER & PROPERTY DAMAGE

EK Disposal Services LLC disclaims all liability for damages of any kind resulting from the delivery, placement, or retrieval of equipment. This includes, but is not limited to, damage to:

  • Driveways, lawns, sidewalks, and septic systems.
  • Residences, structures, and overhead cables.
  • Trees, shrubs, landscaping, and lawn sprinklers.
    Driveway Waiver: Customer acknowledges that dumpsters are heavy and may cause cracking or marking on driveways. Once the dumpster is placed on the Customer's property, any and all damages incurred to persons or property are the sole responsibility of the Customer.
2. EQUIPMENT PROTECTION

Customer is financially responsible for any damage to Company equipment (trucks, trailers, dumpsters) while on-site. This includes repairs for:

  • Misuse, neglect, or overloading.
  • Fires, excessive dents, or punctures in the floor/sides.
  • Damage to doors, locking mechanisms, or hinges.
3. PAYMENT & RENTAL PERIOD
  • Payment: Full payment is required via cash or credit card on or before the delivery date (unless prior billing arrangements exist).
  • Credit Card on File: Customer must keep a valid credit card on file to cover overages, additional days, or penalty fees.
  • Rental Duration: The standard rental period is 10 days.
  • Extensions: Additional days may be purchased at $25.00 per day, subject to availability. The Company reserves the right to deny extension requests.
4. RELOCATION & PLACEMENT

Once an EK Disposal Services LLC employee has positioned the dumpster, it must not be moved or relocated by anyone other than Company personnel. Unauthorized relocation will result in a $150.00 fee plus liability for any resulting damage.

5. OVERLOADING & FAILED PICK-UPS
  • Legal Transport: If a dumpster is overloaded and cannot be legally transported on public roads, the Customer is responsible for unloading the excess material.
  • Fees: A $150.00 failed pick-up fee will apply.
  • Remediation: Customer has 24 hours to correct the load. If not corrected, Company employees will transfer materials to a second dumpster at a rate of $75.00 per hour, plus standard rental fees for the additional dumpster.
6. ACCESSIBILITY

The dumpster must be readily accessible for pickup. Any obstructions (vehicles, snow, locked gates, etc.) preventing retrieval will result in a $150.00 driver return fee.

7. PROHIBITED ITEMS & HAZARDOUS WASTE

The following items are strictly prohibited:

  • Chemicals/Liquids: Paints (oil, aerosol, or water-based), oils, fuels, hazardous materials, and appliances containing Freon.
  • Tanks/Batteries: Propane tanks (empty or full) and batteries of any type.
  • Construction/Debris: Asbestos, fluorescent light bulbs, and tires.
  • Yard Waste: Leaves, grass clippings, soil, rocks, and concrete must not be mixed with standard debris.
    Penalties: If prohibited items are found, they will be unloaded at Customer expense. If discovered during dumping, items may be returned to the Customer for a fee starting at $150.00.
8. TONNAGE LIMITS & OVERAGES

Pricing includes a base weight limit. Any tonnage exceeding these limits will be billed to the credit card on file at a rate of $[Insert Rate] per ton.

  • 5-Yard: 1 ton included.
  • 10-Yard: 2 tons included.
  • 12-Yard: 2 tons included.
  • 15-Yard: 2.5 tons included.
  • 20-Yard: 3 tons included.
  • 30-Yard: 4 tons included.
9. ACCEPTANCE OF TERMS

By providing payment for dumpster rental or other services, the Customer consents to these terms. EK Disposal Services LLC retains the right to amend these terms at any time.
